Moments is built by the Moments team ("we," "us"). When you download or use Moments from the App Store, you agree to Apple's Licensed Application End User License Agreement ("Apple EULA") plus the terms below. Everywhere these terms conflict with Apple's EULA, Apple's wins.
The agreement
By installing, opening, or paying for Moments, you accept these terms. If you don't accept them, don't use the app, and request a refund through Apple if you've already paid.
What Moments is
Moments is a personal voice journal that records audio on your iPhone, transcribes it locally, and uses an on-device AI model to organize what you said into themes, people, commitments, and a short summary. It also lets you query your past entries in plain language.
Every byte of your journal stays on your device. We do not operate servers that hold your audio, transcripts, photos, or AI-generated structure. The privacy policy describes this in detail.
Your moments are yours. We don't claim a license to them, can't see them, and can't recover them if you delete them. Export and back them up regularly.
You own your data
You retain all rights to the content you create in Moments. We don't claim any license to your entries, recordings, photos, or derived metadata. Because nothing leaves the device, we couldn't grant such a license to anyone even if we wanted to.
Conversely, you are solely responsible for what you put into the app. We can't moderate it. We can't recover it if you delete it. Treat your journal like a paper notebook you keep at home, and back it up.
Subscription terms
Moments Premium is a recurring subscription processed by Apple through the App Store.
- Pricing
- $49.99 per year (about $4.17 per month) or $6.99 per month. Prices may vary in non-US storefronts based on Apple's tier pricing.
- Free trial
- 7 days at no charge. Cancel during the trial in iOS Settings → Apple ID → Subscriptions and you will not be charged.
- Auto-renewal
- Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. Apple charges your default payment method.
- Cancellation
- Cancel anytime in iOS Settings → Apple ID → Subscriptions → Moments Premium. You keep access until the end of the current billing period.
- Refunds
- Apple handles all refunds. Request one at reportaproblem.apple.com. We have no visibility into refunds and cannot process them on our end.
- Price changes
- If we change subscription pricing, current subscribers will be notified through the app and via Apple's required disclosures before the next renewal. Continuing to pay after a price change means you accept the new price.
Acceptable use
This is a journal app for one person on one phone. Don't do these things with it:
- Resell, redistribute, or sublicense the app or the AI model weights downloaded by it.
- Reverse engineer the app to extract model weights for redistribution beyond what local law permits.
- Circumvent subscription requirements through pirated builds or modified copies.
- Use the app's mailto contact or feedback channels to harass us, threaten us, or send unsolicited bulk messages.
Everything else, by default, is fine.
AI is not a therapist
Moments uses an on-device language model to summarize and organize what you said. It sometimes gets things wrong. It can miss nuance, invent details, or read a feeling that wasn't there. The original audio recording is always one tap away as ground truth.
Moments is a journal, not a medical, mental health, legal, or financial tool. The AI's output is not professional advice. If you are in crisis, please contact a qualified human. In the U.S., the 988 Suicide and Crisis Lifeline is available at any hour by dialing 988.
Limitation of liability
To the maximum extent permitted by law, the Moments team is not liable for indirect, incidental, consequential, or punitive damages arising from your use of Moments. Our total liability for any direct claim is capped at the amount you paid for the subscription in the twelve months preceding the claim.
This does not exclude liability we are not legally allowed to exclude.
Changes to these terms
If we update these terms, the date at the top of this page changes. Material changes will be flagged in app release notes. Continuing to use the app after a change means you accept the new terms.
Termination
You can stop using Moments anytime by uninstalling the app and cancelling any active subscription through Apple. We can suspend or terminate access for the rare user who abuses acceptable use above, though since the app runs entirely on your device, "termination" mostly means we stop responding to support requests.
Governing law
These terms are governed by the laws of the State of Texas, U.S.A., without regard to its conflict of laws principles. Any dispute that can't be resolved by email goes to the state or federal courts located in Dallas County, Texas.
